Ornaq publishes data and analysis for free, under an open licence. We do our best to make it right, but we can’t guarantee it is accurate, complete or current. You use it at your own risk.

1. About these terms

1.1. These terms apply to the website [ornaq.ai] (the “Website”), including its maps, datasets, downloads and email updates. The Website is run by Fundacja Ornaq, registered at: Ogińskiego 11/9 , 03-318 Warsaw, KRS no. (“Ornaq”, “we”, “us”). Contact: hello@ornaq.ai.

1.2. These terms are the “regulamin” required by Polish law for services provided by electronic means (art. 8 of the Act of 18 July 2002 on Providing Services by Electronic Means). By using the Website, you agree to them. If you don’t agree, please don’t use it.

1.3. How we handle personal data is explained in our Privacy Policy.

2. Our services

2.1. We provide these services free of charge:

  • Browsing the Website, including its maps, analysis and data. This service starts when you open the Website and ends when you leave it.
  • Downloading datasets and files.
  • Email updates about Ornaq. This service starts when you confirm your subscription and runs until you unsubscribe. You can unsubscribe at any time, free of charge, using the link in any email or by writing to us. We may also end the service with [14] days’ notice, or right away if you break these terms.

2.2. Technical requirements. You need an internet-connected device and an up-to-date browser such as Chrome, Firefox, Safari or Edge, with JavaScript enabled for the maps. For email updates, you need a working email address.

2.3. Prohibited use. You must not submit unlawful content. You must not try to disrupt, overload or get unauthorised access to the Website. You must not scrape it in a way that puts an unreasonable load on it. For bulk access, use our downloads, or contact us.

2.4. Risks. Like any online service, using the Website involves general internet risks, such as malware or phishing. Use up-to-date security software, and only trust emails from us that come from [@ornaq.ai].

2.5. Paid services. We may offer paid services in future, such as premium datasets, API access or commissioned analysis. These may be provided by a separate company and will be governed by separate terms, which you’ll accept before you buy. If those terms conflict with these terms, the separate terms prevail for that paid service.

3. Licence: free to reuse, with credit

3.1. Unless stated otherwise, the content and data we publish on the Website are licensed under the Creative Commons Attribution 4.0 International licence (CC BY 4.0). You may copy, share, adapt and use them for any purpose, including commercial use, as long as you give appropriate credit.

3.2. How to credit us: “Source: Ornaq, [title of dataset or publication]”, plus an optional note if you changed anything. Crediting us does not mean we endorse your work.

3.3. Not covered by CC BY 4.0:

  • the Ornaq name, logo and visual identity (these are our trademarks);
  • third-party content and data, marked with their source, which come under their own licences;
  • photographs and images credited to others;
  • the Website’s software code and any other source code, unless published separately under an open-source licence.

3.4. If there is any conflict between these terms and the CC BY 4.0 licence about your rights to reuse licensed content, the licence prevails.

4. No guarantee of accuracy

4.1. Our data and analysis are compiled from public sources, third-party data, estimates and our own modelling. Some of them are incomplete, out of date, or wrong. We make reasonable efforts to check them, but we do not guarantee that anything on the Website is accurate, complete, reliable or current.

4.2. All content and data are provided “as is” and “as available”, without warranties of any kind. This includes warranties of accuracy, fitness for a particular purpose, and non-infringement. This is consistent with section 5 of the CC BY 4.0 licence.

4.3. Figures and statements about data centres, companies, sites, capacity, power demand or projects describe our understanding at the time we published them. They are not statements of fact by the companies concerned. They may differ from those companies’ own disclosures.

4.4. We may correct, update or remove content at any time without notice. We publish our methodology at [TBC] and log significant corrections there.

5. Not advice

Nothing on the Website is investment, financial, legal, tax, engineering, regulatory or other professional advice. Nothing on it is an offer or a recommendation to buy, sell or invest in any asset, site or company. Before you make any decision, verify the information independently and get professional advice where appropriate.

6. Liability

6.1. You use the Website and its content at your own risk. You are responsible for how you use our data and for any conclusions you draw from it.

6.2. To the fullest extent permitted by law, Ornaq and its board members, staff, contributors and partners are not liable for any loss or damage arising from:

  • use of the Website or its content, or reliance on it;
  • errors, omissions or delays in the content;
  • the Website being unavailable;
  • third-party websites we link to.

This includes lost profits, revenue, business opportunities, data or goodwill, and any indirect or consequential loss.

6.3. Nothing in these terms excludes or limits our liability where the law does not allow it, in particular for damage caused intentionally. Nothing in these terms limits rights that consumers have under mandatory law.

We link to third-party websites and sources for reference. We don’t control them and aren’t responsible for their content, availability or privacy practices.

8. Complaints

8.1. If you have a complaint about our services, email hello@ornaq.ai. Describe the issue and how to contact you.

8.2. We will reply within [14] days. To report an error in our data, use the same address. We welcome corrections.

8.3. Consumers can also use out-of-court dispute resolution. Information is available from the Polish consumer protection authority (UOKiK) at uokik.gov.pl.

9. Changes to these terms

We may update these terms, for example when we add services or the law changes. We will post the new version here with a new date. For subscribers, we will email any significant changes at least [14] days before they take effect. You can unsubscribe if you don’t accept them.

10. Governing law

10.1. These terms are governed by Polish law. Disputes will be resolved by the common courts with jurisdiction under Polish law.

10.2. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring proceedings there.

10.3. If any provision of these terms is found invalid, the rest remain in force.
